The use of this site and the registration of an order through it, is deemed to be an acceptance of these conditions. If you DO NOT accept these terms, please do not use this website. "HYPER CLOTHING LTD" reserves the right to change the terms and conditions at any time without prior notice, and the changed terms and conditions will be posted on the site.
I. Terms and Conditions
- "www.hyperclo.com" is an e-commerce website - for the sale and delivery of the goods published therein, on behalf of HYPER CLOTHING LTD.
- The publication on this site has the meaning of a public invitation to conclude a commercial transaction for the purchase of items online from HYPER CLOTHING LTD.
- "HYPER CLOTHING" Ltd through"www.hyperclo.com" is entitled to change the prices of the goods offered at its own discretion, without prior notice. The user is obliged to pay the price that was current at the time of ordering the desired goods. The price reduction is announced by placing the new price below the old price, the latter being crossed out.
- In the event of an incorrect or erroneous address, contact person and/or telephone number being provided when placing the order, HYPER CLOUDING Ltd via"www.hyperclo.com" shall not be bound by any obligation to fulfil the order.
- The contract with the Customer shall be deemed to be concluded upon acceptance by "HYPER CLOTHING" LTD via"www.hyperclo.com" of the purchase application correctly completed by the Customer order process.
- "HYPER CLOTHING" Ltd. via "www.hyperclo.com"is obliged, after receiving an application from the Customer, to deliver the desired goods or to inform the Customer of other circumstances concerning his order.
- "HYPER CLOTHING Ltd. shall not be held liable if the Customer has provided incorrect and/or incomplete data in an order placed at"www.hyperclo.com".
- "HYPER CLOUDING" Ltd. does not guarantee the complete conformity of the items presented on the website and those available in the store network.
- "HYPER CLOTHING" Ltd. is not responsible for any inaccuracies in the information published on the website. Adjustments of prices in the stores are possible, as well as changes in the design of products.
- The information published on the website about sizes and correspondences should be interpreted as indicative. "HYPER CLOTHING Ltd. accepts the existence of discrepancies between the published and actual dimensions, for which it is not responsible.
- The categorisation of the items by intended use is indicative.
- All advertised prices are in Euro including VAT.
II. Rights and obligations of the parties1. "HYPER CLOTHING" Ltd. undertakes:
- confirm the availability of the ordered items or refuse the order within 7 working days;
- deliver the goods requested for purchase within the time specified in the delivery and payment information*.*During Hyper Clothing's major seasonal sales (January/February and July/August/September) online orders have an extended delivery period. The average delivery time during this period is up to 7 working days, depending on the order load and volume in some cases the delivery time may be up to 14 days.
Due to the high volume of orders during these periods, we may not be able to fulfil delivery of all goods ordered by a customer and the customer will be notified of this. It is also possible that delivery may be made in instalments, in the event that the delivery does NOT qualify for Free Delivery, the customer will only pay the first charge and the remaining deliveries will be at the expense of HYPER CLOTHING LTD.
- Each item shall be checked for roadworthiness (if possible without compromising the integrity of the packaging) before being dispatched;
- ensure that all products are factory new (unused!) and sealed by the manufacturer, unless otherwise expressly stated when the goods are presented on the website.
2. The customer undertakes:
- Provide their full name, accurate and valid telephone number, delivery address and e-mail address;
- to pay the price of the goods according to the conditions described in the delivery and payment information;
- to pay the delivery costs according to the conditions described in the delivery and payment information for goods
- provide access to and the ability to receive the goods.
- The goods ordered for purchase shall be delivered to the delivery address specified by the Customer within the time period provided in the delivery and payment information for goods.
The goods shall be delivered suitably packaged according to their type and the transport for delivery. Upon delivery of the goods, the Customer or a third party shall sign the accompanying documents. A third party shall be deemed to be anyone who is not the application holder but accepts delivery of the goods and is at the address specified by the customer. In seasonal sales it is possible that the delivery may be made in parts.
In the event that the Customer is not found within the delivery period at the address specified or access and conditions for delivery of the goods are not provided within that period, HYPER CLOTHING LTD shall be released from its obligation to deliver the goods ordered for purchase. The customer may confirm his/her wish to receive the goods after the expiry of the delivery period in which he/she was not found at the address, bearing all delivery costs. In this case, a new delivery period will start to run accordingly from the moment of confirmation.The customer has the right to refuse receipt of the goods requested for purchase by him when they are delivered to him under one of the following conditions:
- the goods delivered clearly do not correspond to the goods requested for purchase by the Customer and this can be ascertained by simple inspection.
- the price to be paid by the Customer does not correspond to the price due.
- there is a discrepancy between the goods ordered for purchase and the goods delivered which could not be established at the time of delivery.
In the event of a discrepancy between the goods ordered and the goods delivered, the Customer shall be entitled to request a replacement of the size or item listed in their original order. In this case, it is necessary to declare his wish, in writing (by e-mail), within a period not exceeding 14 days at the address of the Customer. The customer has the right to return the received items to the address in Plovdiv, Central, within a period not exceeding 14 days, without compensation or penalty and without giving any reason. "HYPER CLOTHING" Ltd. shall refund all amounts received from the consumer. The costs of returning the goods shall be borne by the customer:
- the request for return of the goods is submitted in writing to the e-mail address for correspondence specified by "HYPER CLOTHING" Ltd., within a period not exceeding 14 days from the date of receipt of the order. The order must contain the customer's personal bank account to which the amount paid by the customer for the goods shall be refunded;
- the goods are in good merchantable condition, original packaging, with original labels, accompanied by the original documents issued by HYPER CLOTHING Ltd - invoice, receipt, warranty card (if any);
- the customer agrees with a representative of HYPER CLOTHING LTD the address where HYPER CLOTHING LTD wishes to receive the goods back;
- in accordance with the provisions of the Consumer Protection Act, HYPER CLOTHING LTD shall refund the customer the amount paid within 14 days from the date on which the customer has exercised his right to return the goods.
When returning goods paid for by cash on delivery, it is necessary to have an identity between the person ordering the goods and the person returning the goods, regardless of who received them. It is the person ordering and returning the goods who will receive back the money paid by cash on delivery. If the person ordering is a child, the money will be returned to the child's account or to the child's legal representative - mother, father, or guardian. For this purpose, it is necessary to present a Birth Certificate or a Decision on the appointment of a guardian.
III. Personal dataHIPPER CLOTHING Ltd. respects the privacy of its customers and ensures the maximum protection of their personal data. Read the Privacy and Data Protection Policy published here. It has been prepared and is based on the current Bulgarian and European legislation in the field of personal data protection.
- "HYPER CLOTHING" Ltd through"www.hyperclo.com" takes due care to protect the Customer's personal data made known when completing the electronic form to make an application for registration on the website and purchase. This obligation is waived if the Customer has provided false data.
- Subject to applicable law, the provisions of these Terms and Conditions and the Privacy Policy, HYPER CLOTHING Ltd may use the Customer's personal data solely for the purposes for which it was provided.
IV. Disclosure of Information
"HYPER CLOTHING" Ltd. through"www.hyperclo.com" undertakes not to disclose any personal data about the Customer to third parties - government authorities, commercial companies, individuals and others, except in cases where:
- has obtained the Customer's express written consent;
- the information has been requested by state authorities or officials who, according to the legislation in force, are authorized to request and collect such information;
- "HYPER CLOTHING" Ltd through"www.hyperclo.com" is obliged to provide the information by law.
V. Liability "HYPER CLOTHING" Ltd. through"www.hyperclo.com"shall not be liable for any failure to perform its obligations under this Agreement in the event of any circumstances which "HYPER CLOTHING" Ltd. through"www.hyperclo.com"did not foresee and was not obliged to foresee - including, but not limited to, acts of God, fortuitous events, problems in the global network of the Internet and in the provision of services beyond the control of "HYPER CLOTHING" Ltd. through"www.hyperclo.com".
VI. ArbitrationAll disputes between the parties shall be resolved amicably and in good faith. In the event that no agreement is reached, all unresolved disputes arising out of or relating to the contract between the parties, including disputes arising out of or relating to its interpretation, invalidity, performance or termination, as well as disputes concerning the filling of gaps in the contract or its adaptation to newly arising circumstances, shall be resolved by the competent court of registration of HYPER CLOTHING LTD in accordance with Bulgarian law.
VII. Warranty Terms:1. HYPER CLOTHING Ltd. provides its customers with a warranty card with each purchased product, in which are mentioned:
- the address and telephone number of the authorized service centers of the purchased equipment;auditor or authorized service centers. Only the original warranty cards with which the goods were received are valid at the service centres.
- the warranty conditions of the respective service centres or manufacturers;
- the warranty period of the purchased goods;
2. Except for the obligations specifically set out in this warranty, HYPER CLOTHING LTD cannot be held liable for direct, indirect, special, incidental or consequential damages, whether based on contract, damage due to the omission of an officer or any other legal theory and whether the possibility of such damages is assumed.
3. All products are subject to the warranty terms of the respective manufacturer.
VIII. Warranty LimitationsWarranty is void in the event of:
- Damage caused by poor transportation, storage or improper operation.
- Attempted repair by the Customer and/or other unauthorized person.
- Use of poor quality and non-original consumables.
IX. Additional conditions:1. "HYPER CLOTHING Ltd. shall not be liable for any damage to the goods due to force majeure.If you do not accept the terms and conditions, please do not use the site!
