HYPER CLOTHING SHOP TERMS AND CONDITIONS
I. GENERAL INFORMATION
- The online store of Hyper Clothing (hereinafter referred to as the "Store") is managed by HYPER CLOTHING LTD, with its registered office in Plovdiv, address. BG206255141. The company is the administrator of the personal data of the customers of the Shop. In the further provisions of the General Terms and Conditions, to simplify communication, we use definitions such as "Hyper Clothing", "we" or other first person plural pronouns.

- These Terms and Conditions ("Terms and Conditions") describe the rules for purchasing the merchandise offered in the Store ("Merchandise"), as well as the terms and conditions for registering for an account, participating in loyalty programs and using other services.
- The Terms and Conditions can be viewed in the "Information" section of the Store, and downloaded in PDF format for storage.
- The information about the goods presented in the Shop constitutes an invitation to conclude a sales contract. The customer's order has the legal meaning of an offer to purchase goods.
- Goods in the Shop are described in detail, including information about their properties, price and material from which they are made.
- All trademarks, company names, photographs, designs and product descriptions are copyrighted and may not be used without the consent of HYPER CLOTHING LTD.
- The purchase of Goods from the Shop is only possible by individuals for personal use and not for commercial purposes.
II. RULES FOR USING THE SHOP AND CONCLUDING A CONTRACT FOR THE SALE OF GOODS
- Review the Terms and Conditions and accept them before placing an order or creating an account on the Shop. Without accepting the Terms and Conditions, you will not be able to make purchases or use other services of the Shop.
- Please ensure that the information provided when placing an order is true and accurate. In the event of any inaccuracies that prevent order fulfillment, we may contact you for corrections.
- We make every effort to ensure the effective and safe use of the Shop in accordance with applicable safety standards.
- You are prohibited from taking any action that would jeopardize the security of the Store or the data of other customers.
- You must comply with the following rules when using the Shop:
(a) Do not interfere with the Shop's system environment by introducing malware or other illegal actions.
b) Use the Shop only for the purpose described in the Terms and Conditions.
c) Do not use the Shop in any way that could disrupt its operation or cause inconvenience to other users.
d) You may not use the contents of the Shop for personal or commercial use without the consent of HYPER CLOTHING LTD.
e) You may not interfere with other customers making purchases by placing excessive or unusual orders.
- Some items in the Shop may be limited in the quantity you can purchase of any one model or colour in one order. You will be notified of these limitations when you add items to your cart.
III. ENTERING INTO A CONTRACT FOR THE SALE OF GOODS
- Hyper Clothing's goods and services may be purchased subject to the terms and conditions described in the Terms and Conditions.
- Orders may be placed 24 hours a day and those placed on weekends will be processed on the first following business day.
- To place an order, you must create an account on the Shop and log in.
- You will need to provide the details required to complete the order. The data will be marked as required on the purchase form. Without them, we cannot fulfil the order.
- To place an order, complete the following steps:
a) Select the goods and add them to the "Shopping Cart". Then proceed to the checkout process.
b) You can modify the contents of the "Cart" before confirming the purchase with the "Buy and Pay" button.
c) Clicking "Buy and Pay" means that you are making an offer to purchase the selected goods on the terms and conditions described in the Terms and Conditions.
- After submitting your order, you will receive an e-mail with information about the goods ordered, their price, delivery, contact details and other relevant information. This message confirms receipt of the order.
- After checking the order, you will receive another message confirming the order or refusal with an explanation of the reasons.
- The order confirmation message means that the sales contract has been concluded.
- You can cancel the order before you receive the order confirmation by contacting Customer Service.
- Orders with online payment will be cancelled if:
(a) Contact details are inaccurate and prevent delivery.
b) Payment is not made within the specified time.
IV. DELIVERY AND ACCEPTANCE OF GOODS
- Goods purchased in the Shop shall be delivered to the address in Europe specified by you in the order.
- The approximate delivery time of the Goods by courier is 3 working days from the day following the dispatch of the parcel. Delivery of your order may be delayed during periods of increased purchases in the Shop, for example during holiday periods. However, we endeavour to ensure that your purchases reach you no later than 7 working days after you receive Confirmation of Order Fulfillment and dispatch. The maximum lead time for order fulfillment may not exceed 30 days. If you choose to pay online, we may delay the fulfilment of your order until we have accounted for the price paid for the Goods.
- The Goods will be delivered by the following methods:
(a) by courier service to the address you have specified in Europe;
b) at the chosen collection point (e.g. collection point of the courier service or other Hyper Clothing partners) - according to the options provided by us.

V. PRICES AND PAYMENT METHODS
- The prices of the Goods in the Shop are quoted in Bulgarian levs and include VAT.
- The current payment methods accepted in the Shop are presented in the "Payment Methods" section of our website and in the purchase process, at the stage of selecting the payment method.
- If you choose to pay online, funds must be credited to your Hyper Clothing account within the time period specified by the Shop. Otherwise, the order will be cancelled. Of course, you can place a new order by choosing another payment method or making the online payment on time.
- We may change the prices of the Goods in the Shop, change the assortment, introduce promotions or other discounts on products, but these changes will not violate the sales contracts already concluded or the rights of the customers benefiting from the given promotion.
VI. RETURNS OF GOODS
- The Shop sells exclusively new and original Goods. Hyper Clothing shall be liable for any non-conformity of the Goods with the contract existing at the time of delivery of the Goods and discovered within two years from that time, in accordance with the regulations in force in this area.
- If you believe that the Goods you have purchased do not conform to the contract, you may make a claim in accordance with the relevant provisions of law and the provisions contained in the General Terms and Conditions.
- You may submit your complaint in the following manner:
(a) send us the Goods advertised with a written description of the defect - you may use the returns form provided by us and downloaded from the Shop page, but this is not compulsory;
b) send the complaint by registered letter or other form of post to:
(c) You will be informed of how your claim will be dealt with within 14 days of receipt of the Goods you are claiming for.
- In accordance with the relevant provisions of the law, if the Goods are purchased by you up to and including 31 December 2021, by submitting your complaint you become entitled to:
(a) request a price reduction (specifying up to what amount) or to cancel the contract if the defect is material. In such a case, we may replace the Goods advertised with new Goods immediately and without undue inconvenience to you or remedy the defect and thereby settle your claim;
b) request replacement of the Goods with Goods free from defect or rectification of the defect. If both repair and replacement are impossible or require excessive expense, we may refuse to bring the Goods into conformity with the Contract in the manner you choose, i.e. by repair or reconditioning. In such a case you shall be entitled to rescind the contract or to a reduction in price.
- In the event of a complaint being disregarded, we will return the Goods to you together with a statement as to whether the complaint is unfounded.
- On receipt of the item, please note whether it is damaged. If you find any damage to the Goods, ask the carrier or the person issuing the Goods to you at the point of collection to draw up a report of damage to the Goods.
- Out of Court Dispute Resolution:
(a) If you are purchasing the Goods as a consumer, you are entitled to use the out-of-court dispute resolution and claims seeking method through the ODR (Online Dispute Resolution) platform, pursuant to Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes.
b) The ODR platform is an interactive tool provided to consumers by the European Union through which you can lodge a complaint.
VII. RETURN OF GOODS - WITHDRAWAL FROM THE SALES CONTRACT
If you are purchasing the Goods as a consumer, you have the right to withdraw from the sales contract without giving reasons, in accordance with the rules set out below. The right of withdrawal from a distance contract does not apply to:a. the sale of sealed goods which are unsuitable for return for reasons of health or hygiene and the packaging of which has been opened after delivery;b. the sale of sealed sound or video recordings or sealed computer software the packaging of which has been opened after delivery;c. the sale of newspapers, periodicals or magazines except for subscription contracts.
You may cancel the contract for the sale of the Goods in the Shop within 14 days of receipt of the Goods.
You may exercise your right of withdrawal as follows:
(a) notify us of your decision to cancel the Contract by email to: office.hyperclothing@gmail.com or in writing to the Shop;
VIII. WITHDRAWAL FROM THE CONTRACT FOR THE SALE OF GOODS
- If you decide to withdraw from the contract for the sale of goods:
(a) You are liable for the costs of sending the goods to us associated with the cancellation.
b) We will return the funds received from you immediately, but no later than 14 days after we receive your declaration of withdrawal. We will also refund the cost of delivery and money order if you are returning all the goods purchased in one order. We may delay your refund until we receive the returned goods or proof of dispatch.
c) Refunds will be made by the same method used for payment unless you agree to another method. In any event, you will not be burdened with additional costs.
- Under the law, you are liable for any diminution in the value of the returned goods resulting from their being used in a manner other than necessary to establish their nature, characteristics and functions.
IX. RETURN OPTIONS
- If the value of the goods you have purchased exceeds the threshold for free return (taking into account any applicable discounts and promotions), you may use the free return option upon withdrawal from the contract. The method of use and the free return threshold are described on the "Returns" page.
- You may not be able to use the free return option - you have the right to cancel the contract for the sale of goods within 30 days of receipt, subject to the cost of return.
X. INFORMATION ON SERVICES PROVIDED ELECTRONICALLY
- We provide the following services electronically through the Hyper Clothing store:
(a) The possibility to conclude contracts for the online sale of goods.
- You have the right to withdraw from contracts concluded for the sale of goods according to the relevant provisions of the law and these General Terms and Conditions.
- In case of cancellation of the service of maintaining the store account or participation in the loyalty program, you have the right to do so within 30 days from the creation of the account by informing us at office.hyperclothing@gmail.com.
XI. LOYALTY PROGRAM
- After registration of the store account, you can enjoy a point bonus within the loyalty program implemented by Hyper Clothing. The bonus is 10% of the value of the purchases made and is not redeemable for cash.
- The bonus can only be used for in-store purchases and is charged on the value of the purchases made, rounded up to the nearest whole Euro.
- The bonus cannot reduce the price of the goods by more than 50% of their original price.
- In the event of a return, the used premium will be refunded to your account.
X. FRAUD PREVENTION
- Hyper Clothing reserves the right to refuse to accept an order or to block an account in the event of a material breach of the store's terms of use.
- We will notify you of any account blocking by email and give you an opportunity to present your position.
XII. FINAL PROVISIONS
- Before entering into a contract for the sale of goods, please read the General Terms and Conditions.
- European law applies to the sale of goods in the shop.
- Changes to the General Terms and Conditions will be applied to contracts concluded after their entry into force.
